This privacy policy explains how "AYYEKA TECHNOLOGIES" (the "Company") handles your personal information and data and it applies to all services offered by the Company and any affiliated entity, including but not limited to, Company's website at https://www.ayyeka.com and any other application of ours that links to this privacy policy ("Services").

The information that we receive and collect depends in part on what you do when you use our Services and falls generally into one of two categories: information you or your employer submit, and information collected automatically when you access and/or use our Services.

IoT Device and Field Sensor Data

As part of our core Services, the Company operates the Wavelet industrial telemetry device and the FAI (Field Assets Intelligence) cloud platform. In the course of providing these Services, we may collect and process data originating from IoT devices and field sensors deployed at your sites. This may include:

  • Sensor readings and measurements (e.g., water level, flow rate, pressure, temperature)
  • Device identifiers and configuration data
  • Site identifiers and location metadata associated with deployed devices
  • Event and alert data generated by field assets
  • Timestamps and sampling frequency data

This data is collected for the purpose of providing operational monitoring, alerting, and analytics services to our clients. Where such data is associated with an identifiable individual (e.g., site contact details linked to a device), it is treated as personal data and handled in accordance with this policy.

Information Collected During E-Mail Communications

During or related to your accessing the services, you may send an e-mail or other electronic communication to us. When you send an e-mail or other electronic communication to us, you are communicating with us electronically and consent to receive reply communications from us electronically. We may retain the content of the e-mail or other electronic communication, your e-mail address or other identifier, and our response in order to better service your needs or for legal and regulatory reasons.

Usage Data

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your Internet Protocol address (e.g. IP address), browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information.

This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Tracking Technologies and Cookies

Like many businesses, we also collect information through cookies and similar technologies. When you view our website, we may store some information on your computer in the form of a "Cookie" to automatically recognize you the next time you visit. Cookies allow web applications to respond to you as an individual.

The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.   • Share in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, our affiliated companies or acquiring company will assume the rights and obligations as described in this privacy policy.

  • Make aggregate, anonymized, or anonymous data available to third parties for research or other purposes. Such anonymized data does not contain any personally identifiable information and is processed in accordance with GDPR standards for anonymization.   • For other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Service, products, services, marketing and your experience, where such use is consistent with the purposes described in this policy and applicable law.

Communications and Notifications

We may use your phone number to send operational SMS notifications related to your use of the Services, such as field asset alerts and system events. These messages are transactional in nature and are not used for marketing purposes. You may opt out of receiving SMS notifications at any time by removing your phone number from the platform settings or by contacting us at support@ayyeka.com.

SECURITY AND STORAGE

We are concerned about safeguarding the confidentiality of your information. We adhere to accepted industry security standards (e.g. ISO 27000 Series) that are designed to protect any non-public personal information collected by our Services against accidental or unauthorized use, access, or disclosure.

We provide physical, electronic, and procedural safeguards to protect information we collect, process, and maintain. All of your personal information resides in a secure database behind a firewall where it cannot be accessed without proper authentication. Information collected by our Services is protected by Secure Socket Layer ("SSL") technology, a leading security protocol for data transfer on the Internet.

Please remember that no method of transmission, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

DATA BREACH NOTIFICATION

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the relevant supervisory authority without undue delay and, where feasible, within 72 hours of becoming aware of the breach, in accordance with Article 33 of the GDPR and the applicable requirements of the Israeli Privacy Protection Law.

Where a breach is likely to result in a high risk to your rights and freedoms, we will also notify you directly without undue delay, unless we have implemented technical and organizational measures that render the personal data unintelligible (e.g., encryption), or other conditions apply that allow us to delay or omit notification as permitted by law.

All data breaches are recorded internally in our breach register and assessed in accordance with our Incident Response Policy.

RETENTION PERIOD

Information collected from visitors to the website will only be kept for the duration necessary to provide the required service. In the event you become a client of the Company, your data will be retained for the duration of your client relationship with us, and for a period of 3 years after that to identify issues, respect claim limitation periods, and to resolve any legal proceedings.

We retain aggregate information beyond this time for research purposes and to help improve our Services. All information is held and ultimately destroyed in accordance with the Company's data retention policy. You have the right to request that your information be updated, amended or deleted from our records by contacting us using the details provided in the 'Contact Us' section of this policy.

The Company conducts regular reviews of the personal data we hold and will securely erase or anonymize any data that is no longer necessary for the purposes for which it was collected.

INTERNATIONAL DATA TRANSFERS

In the course of providing our Services, your personal data is stored and processed on servers located in the United States (Amazon Web Services). This means that your personal data will be transferred to and processed in a country outside of your home country, including outside of the European Economic Area (EEA) and outside of Israel.

We ensure that such transfers comply with applicable data protection laws, including the GDPR and the Israeli Privacy Protection Law. Specifically:

  • For transfers from the EEA: We rely on Standard Contractual Clauses (SCCs) approved by the European Commission (Commission Implementing Decision 2021/914) as the legal mechanism for transferring personal data to the United States.
  • For transfers from Israel: We rely on equivalent contractual safeguards recognized under Israeli data protection law, consistent with guidance issued by the Israeli Privacy Protection Authority (PPA).
  • Our cloud infrastructure provider: Amazon Web Services, Inc. (AWS) acts as a data processor on our behalf and is bound by AWS's Data Processing Addendum, which incorporates the applicable SCCs and other required safeguards.

We only engage sub-processors that provide sufficient guarantees to implement appropriate technical and organizational measures to ensure the protection of your personal data. A copy of the applicable transfer mechanisms is available upon request by contacting us at support@ayyeka.com.

SUB-PROCESSORS

We engage trusted third-party service providers (sub-processors) to assist in delivering our Services. These sub-processors process personal data on our behalf and are contractually bound to handle such data in accordance with this policy and applicable data protection law. Our primary sub-processors include Amazon Web Services, Inc. (AWS), which provides cloud infrastructure and data storage in the United States. We will provide notice of any intended changes to our sub-processors. Where required by applicable law or contract, we will provide direct notice to affected customers.

LEGAL BASES FOR PROCESSING

We process your personal data on the following legal grounds:

  • Consent: Where you have given us explicit consent to process your data for specific purposes.

SAFETY OF MINORS
